Atlas Warranty

Atlas supports a one year, 365-day Limited Warranty.

Atlas Wearables (“Atlas”) warrants the Atlas Wristband fitness-tracking device (the “Device”), and only the Device, against defects in materials and workmanship under normal use for the period of 365 days from the original date of retail purchase (“Warranty Period”). This warranty is only valid for the original retail consumer (“Consumer”) with valid proof of purchase. The warranty policy covers only Devices purchased through atlaswearables.com or authorized dealers.

All straps and accessories are covered by a manufacturer warranty for 90 days from the original date of retail purchase.

Warranted Functionality. Atlas warrants to the Consumer that the Device will under normal use function substantially in accordance with Atlas’ published guidelines ("Warranted Functionality") for a Warranty Period of 365 days. If and to the extent the Device needs Atlas software or services to achieve the Warranted Functionality, Atlas will make and keep software and services available during the Warranty Period, provided that Atlas may update, modify or limit such software and services at Atlas’ sole discretion so long as the Warranted Functionality is maintained or exceeded.

Limitations. The Limited Warranty applies only to the Device. The Limited Warranty does not apply to any (a) Atlas products and services other than the Device (such as accessories), (b) non-Atlas hardware product, or (c) software, even if packaged or sold with the Device or embedded in the Device. Refer to the licenses accompanying the software for details of Consumer’s rights with respect to its use.

No Atlas reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty.

Exclusions. The Limited Warranty is not applicable to (a) normal wear and tear (including without limitation cosmetic damage such as scratches, dents, nicks, and rust), (b) defects or damage caused by misuse, accident, spillage of food or liquid, fire, other acts of nature or external causes, abuse, unusual stress, or improper storage, (c) alteration, modification, testing, improper or unauthorized repair, (d) use not in accordance with the published guidelines, (e) damage caused by use with unsuitable devices, software or services, (f) commercial use, (h) used or resold products, and (i) use for medical, healthcare or treatment purposes.

Remedies. Consumer's sole and exclusive remedy, and Atlas’ sole and exclusive responsibility under this Limited Warranty, if a Device defect arises and a valid claim is received by Atlas within the Warranty Period, at its option and to the extent permitted by law, Atlas will either repair the Device at no charge, using new or refurbished replacement parts, replace the Device with a new or refurbished product, so that it performs substantially the Warranted Functionality. If Atlas, in its sole discretion, determines it is not reasonable to replace or repair the defective Device, Atlas may refund to Consumer the purchase price paid for the Device.

Claims. To obtain warranty service, Atlas must receive the claim before the end of the Warranty Period. Contact support@atlaswearables.com with proof of purchase. Our Support Team will supply you with a Return Merchandise Authorization (RMA) number to be included with the returned product. You will be responsible for return shipping charges and any risk of damage to or loss of product while in transit to Atlas. We highly recommend that you use a tracking service for your protection.

By sending the Device, you agree to transfer ownership to Atlas. Atlas may not return the original Device. It is your responsibility to backup any data, software, or other materials stored or preserved on the Device. It is likely that such data, software, or other materials will be lost or reformatted during service, and Atlas will not be responsible for any such damage or loss. Atlas warrants that any repaired or replaced Device is covered for the greater of either the remainder of the original Warranty Period or 90 days following receipt of the repaired or replacement Device.

Atlas shall bear the cost of shipping the product back to you after the completion of service under this Limited Warranty. Any product returned to Atlas without a valid warranty claim or without a RMA may be rejected, returned at sender’s cost (subject to prepayment), or kept for 30 days and then disposed of at Atlas’ sole discretion.

International Purchases. A separate warranty may be provided by international distributors for devices purchased outside the United States depending on the country. If applicable, the local in-country distributor provides this warranty and local service for your device. Distributor warranties are only valid in the area of intended distribution. Devices purchased in the United States, Canada, or Mexico must be returned to the Atlas service center in the United States for service.

DISCLAIMER. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES (INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) SHALL BE LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD. ATLAS SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, EVEN IF ATLAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply.
